合同没要求就不如实说?房子有“瑕疵”也得挑明了卖
在二手房买卖中,是否为“凶宅”、有无漏水都要求写进交易合同,但火灾、屋外发生非正常死亡等瑕疵往往被忽视或未作为合同约定的告知项目。当得知购买的二手房是“火烧房”、邻宅命案房后,买家不得不诉诸法院进行维权。对此,法官提示,对于房屋重大瑕疵,即便合同没有明说,卖房人根据诚实信用原则,也有义务如实告知。同时,中介公司也应建立更完善的核查机制。
