《宪法诉讼法》现行规定，参与评议的大法官人数不得低于10人。作成违宪宣告时，同意违宪宣告大法官人数不得低于9人。然而，目前现任大法官仅8名，宪法法庭暂时停摆，新一批大法官人事至少须通过2人，才能让宪法法庭开始运作。
